The moving, removal or exhumation of a person’s remains (including cremated remains) from one burial place to another requires prior written consent from the Council in the form of an Exhumation Licence.
Exhumations are only considered in exceptional circumstances. Due regard for respect to the deceased person, other interred remains in the burial ground and privacy of the family and friends of the deceased person must be protected at all times.
Exceptional circumstances that may be considered include the following:
- When a court orders an exhumation as part of a criminal investigation.
- For public health reasons (for example if a graveyard or cemetery is being moved)
- For family reasons (for example if the family of the deceased person asks for the remains to be moved to another burial ground, another part of the country, or abroad).
Exhumation licences are considered by the local authority on receipt of a completed application form with the following:
- The appropriate fee (currently €300).
- A copy of the death certificate of the deceased person.
- A completed certificate from the Director of Public Health at your local Health Office (HSE).
- A completed form of consent from the cemetery management.
